Twilio.org Impact Access Program Terms

BY SUBMITTING A SUBMISSION FORM FOR TWILIO.ORG’S IMPACT ACCESS PROGRAM ("PROGRAM"), YOU OR YOUR ORGANIZATION (COLLECTIVELY, "YOU" OR "YOUR") AGREE TO THE TERMS OF THE TWILIO.ORG IMPACT ACCESS PROGRAM TERMS ("TERMS") SET FORTH BELOW. IF YOU DO NOT AGREE TO THESE TERMS, YOU SHOULD NOT SUBMIT A SUBMISSION FORM FOR THE PROGRAM. TWILIO MAY MODIFY THESE TERMS FROM TIME TO TIME AND INFORM YOU BY POSTING A MODIFIED VERSION AT HTTPS://WWW.TWILIO.COM/LEGAL/IAP-TERMS. TWILIO ENCOURAGES YOU TO REVIEW THESE TERMS FROM TIME TO TIME AND REFER TO THE LAST UPDATED DATE SET FORTH ABOVE TO SEE WHEN THESE TERMS WERE LAST UPDATED. YOUR CONTINUED PARTICIPATION IN THE PROGRAM CONSTITUTES YOUR ACCEPTANCE OF ANY MODIFIED VERSION OF THESE TERMS.

1. Eligibility and Program Participation. Your participation in the Program is subject to completion of the Program submission form within Your account and approval by Twilio. You agree the information and supporting documentation provided in Your Program submission form is complete, true, and accurate. In order to be approved to participate in the Program, You must meet the applicable eligibility criteria set forth at https://www.twilio.org/check-eligibility ("Eligibility Criteria"). Twilio will review Your Program submission form to determine if You meet the applicable Eligibility Criteria and inform You if you have been accepted into the Program within ten (10) business days via Your account. If You are not accepted into the Program and believe the decision was made in error, You may re-submit a Program submission form via Your account.

2. Program Credit. Twilio will provide You with a one-time credit of $100 USD, £80, ¥13,350, or $150 AUD, whichever is applicable, as determined by the currency used in Your account, within one (1) business day after Your acceptance into the Program ("Credit"). In order to receive the Credit, Your account must be an upgraded account. You acknowledge and agree that You are eligible for the Credit only one time on each Account String Identifier (SID) under Your account; provided, however, Twilio may, in its sole discretion, limit the number of times You receive the Credit, in the aggregate, regardless of the number of Account SIDs that exist under Your account.

3. Other Twilio Fund Program Credits. Notwithstanding anything to the contrary in Section 2 (Program Credit), if You are accepted into Twilio Startups or Twilio Launch (collectively, "Other Twilio Credit Programs") and receive any credits associated with Other Twilio Credit Programs prior to being accepted into the Program, You will not receive the Credit. 

4. Program Removal. Twilio, in its sole discretion, may remove You from the Program immediately upon written notice if (a) You no longer meet the applicable Eligibility Criteria; (b) Your Program submission form contains incomplete, untrue, or inaccurate information or supporting documentation; (c) You close Your account; or (d) Twilio terminates its agreement with You for the use of its services because of Your material breach and failure to cure.

5. Publicity Rights. You are not authorized to use Twilio’s or Twilio.org’s name, logo, or trademarks (collectively, "Twilio Marks") without Twilio’s prior written consent. Your use of any Twilio Marks that Twilio grants You in writing must be in accordance with Twilio’s use guidelines, the current version of which is available at https://www.twilio.com/legal/logo-use.

6. Governing Law. These Terms will be governed by and interpreted in accordance with the laws of the State of California, without regard to conflicts of laws and principles that would cause the laws of another jurisdiction to apply. Any legal suit, action, or proceeding arising out of or related to these Terms or the Program will be instituted in the state or federal courts of San Francisco, California, and each party consents to the personal jurisdiction of these courts.
